Today, a new legislative proposal was introduced by Congressman Brian Fitzpatrick alongside Congresswomen Sarah McBride and Haley Stevens. The bill, known as the FAIR Leave Act, aims to amend current regulations under the Family and Medical Leave Act (FMLA). It seeks to address what proponents see as an unfair limitation on married couples who work for the same employer.

Under existing rules, these couples are required to share a single 12-week leave period provided by FMLA. The FAIR Leave Act proposes to eliminate this restriction, ensuring that each spouse is entitled to their own 12 weeks of unpaid, job-protected leave.

Congressman Fitzpatrick commented on the need for reform: “Our family leave policies are outdated and fail to reflect the real needs of today’s working families.” He emphasized that couples should not be penalized due to their marital status when it comes to accessing full leave benefits.

The FMLA is designed to help employees manage work with serious family or medical situations such as welcoming a child or caring for an ill family member. However, dual-employed couples currently face reduced protection under these provisions. The proposed act would guarantee full leave entitlement for each spouse, removing the current penalty faced by such families.

Rep. McBride shared her personal experience regarding family leave: “No one should have to choose between caring for a loved one and keeping their job.” She recounted her own situation when her late husband was diagnosed with cancer while they both worked for the same employer.

Rep. Stevens highlighted how the act would support new parents: “The FAIR Leave Act is bipartisan, common sense legislation that will allow new parents working for the same employer to access a full 12 weeks of job-protected leave each after the birth or adoption of their child.”

The legislation has received backing from several organizations including the National Partnership for Women and Families and Paid Leave for All.
